Nondiscrimination and Accessibility for Individuals with Disabilities and Individuals with Limited English Proficiency, 15-100

APPLICABILITY

The Department of Behavioral Health and Developmental Disabilities (DBHDD).

POLICY

DBHDD complies with applicable Federal civil rights laws and does not discriminate on the basis of race, color, national origin, age, disability or sex. DBHDD does not exclude individuals or treat them differently because of race, color, national origin, age, disability, or sex. DBHDD provides free aids and services to qualified individuals with disabilities to assist in communicating effectively with us. DBHDD provides free language services to individuals whose primary language is not English to assist in communicating effectively with us. DBHDD has adopted an internal grievance procedure providing for prompt resolution of complaints alleging any action prohibited by Section 1557 of the Affordable Care Act (42 USC 18116) and its implementing regulations at 45 CFR part 92, issued by the U.S. Department of Health and Human Services.

PROCEDURES

  1. Notice, Nondiscrimination Statement and Taglines
    1. In significant publications and significant communications that are not small-sized, in conspicuous physical locations where DBHDD interacts with the public, and in a conspicuous location on DBHDD's website:
      1. The following notice and nondiscrimination statement shall be posted:
        1. DBHDD does not discriminate on the basis of race, color, national origin, sex, age, or disability in its health programs and activities;
        2. DBHDD provides appropriate auxiliary aids and services, including qualified interpreters, for individuals with disabilities and information in alternative formats, free of charge and in a timely manner, when such aids and services are necessary for an equal opportunity to participate to individuals with disabilities;
        3. DBHDD provides language assistance services, including translated documents and oral interpretation, free of charge and in a timely manner, when such services are necessary to provide meaningful access to individuals with limited English proficiency;
        4. Free aids and services such as qualified sign language interpreters and written information and other formats (large print, audio, accessible electronic format, other formats) and free language services such as qualified interpreters and information written in other languages can be obtained by contacting the following:

    2. Taglines in the top 15 languages spoken by individuals in Georgia with limited English proficiency shall be posted, as follows: Spanish; Vietnamese; Korean; Chinese; Gujarati; French; Amharic; Hindi; French Creole; Russian; Arabic; Portuguese; Persian; German; and Japanese.
      1. A copy of the notice, nondiscrimination statement and taglines to be posted at 2 Peachtree St and on the website and in publications is attached hereto as Attachment A.
      2. A copy of the notice, nondiscrimination statement and taglines to be posted at the DBHDD hospitals is attached hereto as Attachment B.
      3. A copy of the notice, nondiscrimination statement and taglines to be posted in the Regional Field Offices is attached hereto as Attachment C.
    3. In significant publications and significant communications that are small-sized:
      1. The following nondiscrimination statement shall be included:
        1. DBHDD does not discriminate on the basis of race, color, national origin, sex, age, or disability in its health programs and activities.
      2. Taglines in the top 2 languages spoken by individuals in Georgia with limited English proficiency shall be posted, as follows: Spanish; and Vietnamese.
      3. A copy of nondiscrimination statement and taglines to be included is attached hereto as Attachment D.
  2. Responsible Employee
    1. To coordinate DBHDD's efforts to comply with and carry out its responsibilities under section 1557 and enabling regulations, as well as all applicable federal law and regulations, and to investigate any grievances communicated to DBHDD, DBHDD designates:

    2. In coordinating DBHDD's efforts, the Office of Constituent Services shall coordinate and communicate with the Office of Deaf Services and the Hospital Access Coordinators. See DBHDD Hospital Access Coordinators, 15-101.
  3. Grievance Procedures
    1. If an individual feels that DBHDD has failed to provide services or discriminated in any other way on the basis of race, color, national origin, age, disability, or sex, she or he can file a complaint with:
